Qualifying for the O-1 Visa

Meeting the eligibility requirements for the O-1 visa is not always straightforward. An applicant must establish they have “extraordinary ability” in the arts, sciences, athletics, business, or education. If an applicant does not have an internationally recognized, self-proving achievement, they will instead need to provide evidence of sustained national acclaim.

  • Made a contribution of major significance to your field

If you are seeking an O-1B visa as an artist of extraordinary ability, you must have accomplished at least three of the following:

  • Received a high salary or other forms of compensation for your work or services
  • Performed or will perform in a lead capacity for a prestigious production or organization
  • Attained recognition in major media publications

  • Secured recognition and recommendations from relevant organizations, critics, and/or experts in your specific field

Benefits of the O-1 Visa

Though the O-1 visa is technically a temporary, non-immigrant visa, one of its key advantages is that it can potentially facilitate an indefinite working relationship in the United States. The O-1 visa is initially valid for three years but can be renewed in one-year increments indefinitely. In other words, so long as you continue to work for your sponsoring employer, you can remain in the United States for an unlimited amount of time

Support teams of O-1 visa recipients can travel to the United States after obtaining O-2 visas. To qualify for the O-2 visa, a support staff member must demonstrate that their presence in the U.S. is necessary because they either will help the O-1 visa holder complete their work or provide specialized knowledge or skills that will otherwise not be available. 

Spouses and unmarried children under the age of 21 are generally permitted to accompany O-1 visa recipients to the United States via the O-3 visa. However, they are not eligible for work authorizations. 

There is no limit to the number of O-1 visas that can be issued each year. Applications also tend to be processed more quickly than other types of work visas.
